Family and inheritance law
We provide legal advice relating to wills, marriage
settlements, cohabitation agreements for unmarried partners,
custody issues and issues relating to the division of property
following a separation.
At some point in your life you will be affected by inheritance law.
You should be aware that the distribution of funds in an estate is
dependent on whether the deceased has written a will. Writing a
will and a marriage settlement is often a profitable option. For
example, in the instance of a merger or acquisition, it can be
advantageous to include private law at an early stage of the
process.
If you are a company owner, a marriage settlement can ensure that
your company won't be involved in the settlement should your
marriage end in separation and divorce. Similarly, in the event of
a death a marriage settlement can protect a company and help ensure
its survival.
If the company in question is your separate estate and your partner
dies, the company's value is excluded from the administration of
the deceased's estate. If, on the other hand, you as the company
owner die first, the combination of a will and marriage settlement
allows you to bequeath as much as possible to your partner or your
children.
You can also use inheritance law, and thereby a will, to limit your
children's inheritance to a maximum of DKK 1,080,000 per
child. The way you arrange your affairs in relation to family law
will also, of course, have consequences for your tax position.
Something we take into account when providing you with
advice.
Probate treatment
DAHL provides both authorised and non-authorised probate
treatment depending on the customer's requirements.
As a member of the deceased's family you may be asking yourself
what will happen to the deceased's company, property, bills, bank
accounts etc., or what situation the deceased's partner will be
left in.
We carry out probate treatment quickly and efficiently, bringing
clarity to inheritance and taxation issues and ensuring that the
process is completed in the most advantageous possible
manner.
A period of 3-4 weeks will normally pass before you will receive a
summons from the probate court. It is often advisable to contact us
well in advance so that we can address any questions you may have
and discuss how to proceed.
At DAHL the first hour's consultation is free of charge.
